AML Obligations

As a real estate intermediary, Pixel Estate EOOD is an obligated entity under Art. 4, para. 1, item 18 of the Anti-Money Laundering Act (AMLA) and Art. 9 of the Measures Against the Financing of Terrorism Act (MAFTA).

In accordance with these regulatory requirements, before entering into an intermediation agreement or establishing a business relationship, we perform Customer Due Diligence (CDD). The purpose is to identify and verify the identity of clients, establish the beneficial owners, and determine the origin of funds.

Required Documents

For the purposes of customer due diligence, every client — whether a natural or legal person — is required to provide the following documents:

  1. Copy of an identity document — national ID card or passport of the natural person (or of the legal representative in the case of a legal entity).
  2. Politically Exposed Person (PEP) declaration — under Art. 42, para. 2, item 2 of AMLA. Each client declares whether they are, or have been, a person holding a prominent public function.
  3. Beneficial owner declaration — under Art. 59, para. 1, item 3 of AMLA. For legal entities, the natural person who ultimately owns or controls the client is established.
  4. Source of funds declaration — under Art. 66, para. 2 of AMLA. The client declares the origin of the financial resources used in the transaction.
  5. Client questionnaire — containing information about the purpose and nature of the business relationship, the expected volume and type of operations.

For Legal Entities

In addition, the following are required:

  • A current certificate of incorporation from the Commercial Register or an equivalent document from the relevant jurisdiction.
  • Documents certifying the powers of the legal representative.
  • An extract from the Register of Beneficial Owners.

Data Storage and Protection

All collected documents and data are stored securely in accordance with the requirements of AMLA (Art. 67) and the General Data Protection Regulation (GDPR, Regulation (EU) 2016/679). The retention period is 5 years after the termination of the business relationship. Access to the documents is restricted to authorised employees and the competent supervisory authorities.

Refusal of Transaction

In the event of failure to provide the required documents or inability to perform customer due diligence, Pixel Estate EOOD is obligated to refuse to establish a business relationship or execute a transaction, in accordance with Art. 36 of AMLA.
